The Ministry of Commerce has decided to lift the anti-discrimination measures of imposing additional tariffs on certain Canadian imported goods.

On March 8, 2025, the Ministry of Commerce (hereinafter referred to as the "Investigation Authority") issued Announcement No. 11 of 2025, announcing the ruling on the anti-discrimination investigation into the relevant restrictive measures imposed by Canada on China and the anti-discrimination measures to be taken. Given the current changes in circumstances, the Investigation Authority has decided to adjust the anti-discrimination measures. The relevant matters are hereby announced as follows:
 
I. Anti-discrimination Investigation Situation
 
According to Article 7, Article 36 and Article 37 of the "Foreign Trade Law of the People's Republic of China", on September 26, 2024, the Ministry of Commerce issued Announcement No. 40 of 2024, deciding to conduct an anti-discrimination investigation into the restrictions imposed by Canada on the import of certain electric vehicles and steel-aluminum products from China, including the imposition of additional tariffs.
 
On March 8, 2025, the Ministry of Commerce issued Announcement No. 11 of 2025. In accordance with the relevant provisions of the "Foreign Trade Law of the People's Republic of China" and the "Customs Tariff Law of the People's Republic of China", in response to the discriminatory measures taken by Canada, such as imposing tariffs on imported electric vehicles and steel-aluminum products from China, the Ministry of Commerce has taken counter-discriminatory measures and imposed tariffs on certain imported goods originating from Canada.
 
II. Adjustment of Measures
 
According to the 11th announcement of the Ministry of Commerce in 2025, anti-discrimination measures can be adjusted, suspended or cancelled in accordance with the procedures under the following circumstances: (1) The government of the country (region) being investigated has adjusted or cancelled the measures or practices under investigation; (2) The government of the country (region) being investigated has provided appropriate compensation to China for the damages caused; (3) The country (region) being investigated and China have reached a consensus solution through consultation and other means; (4) The government of the country (region) being investigated takes further substantive measures; (5) Other appropriate circumstances.
 
Recently, China and Canada have reached a preliminary joint arrangement for handling related economic and trade issues. The Canadian government has officially announced some adjustments to the restrictions on the imposition of tariffs on steel and aluminum products imported from China. The investigation authority, after verification, found that it complies with the circumstances described in items (1) and (3) above, and has decided to make corresponding adjustments to the current anti-discrimination measures. For imported goods from Canada, the anti-discrimination measures-related tariffs will not be imposed. The adjustment of the imposed tariffs measures will be announced separately.
 
III. The validity period of this announcement is from March 1, 2026 to December 31, 2026.
